Probate Real Estate Agent in San Diego.
A probate real estate agent sells a house after someone has died. We help San Diego families understand the steps before they have authority to sell, take care of the house while they wait, and have it ready to sell for top dollar the day authority comes.
What a probate specialist does for your family.
A probate real estate agent, sometimes called a probate realtor, sells a house that belonged to someone who has died, working for the executor, administrator or successor trustee and alongside the family’s probate attorney. At Lovery Real Estate, Ryan Fisher helps San Diego County families before they have authority to sell, takes care of the house while they wait, covers preparation costs upfront through the Lovery Concierge Program and handles the sale through closing.
Most of what slows an estate sale down is not the court. It is families who are not sure what the next step is, or who to trust for the answer.
Our job is to take that off your plate: the title questions, the vendors, the house itself and the sale, so the family can focus on each other while the legal side moves.
Three things we take off your plate.
Clarity on the steps
Before anyone can sign a listing, we help you understand what needs to happen and in what order: how title was held, whether probate is needed, who to call and when. The first-week sequence is in who to call first when you inherit a house.
Care for the house
Keeping the mortgage current, the utilities on and the insurance in place, handling a renter if there is one, and scheduling the cleanout, estate sale and repairs, so nothing slips while the legal side moves.
Ready to sell
Preparation, photos and the marketing plan done in advance. Through the Lovery Concierge Program, Ryan covers pre-listing work upfront, so the estate is not writing checks before it has sale proceeds.

Every estate is different. Here is how each works.
The situations we handle most, and where to read more about each one.
Sales with full authority
Heirs get a Notice of Proposed Action and the sale closes like a normal escrow. The court calendar is in how long probate takes in California.
Court-confirmed sales
Limited authority, or a will that requires court supervision, means a confirmation hearing where others can overbid. How it works is in probate court confirmation in California.
Trust sales for successor trustees
No court case, but there are still trustee notices, title requirements and an accounting to the beneficiaries. Start with our guide to selling an inherited house.
Inherited homes with a loan
Keeping the loan current, talking to the servicer, and deciding whether to keep, refinance or sell. Options are in inheriting a house with a mortgage.
Heirs who disagree
A clear plan and real numbers for every heir, so the family can decide together. See when heirs disagree about selling and selling with multiple owners.
Care and preparation
Utilities, insurance, any renter, the cleanout, the estate sale and the repairs worth making, coordinated locally. Preparation is covered upfront through the Lovery Concierge Program.
How we handle an estate sale, step by step.
Understand the situation and the title
We meet, pull the tax records and have our title team run a preliminary title report, so we are working from what the record actually shows: who is on title, how it was held and any red flags that need clearing.
Get the legal path clear
Trust, small estate procedure or full probate is a legal determination, so we connect the family with a trusted probate attorney. The routes are in our guide to selling an inherited house in San Diego.
Care for and prepare the property
Mortgage, utilities, insurance, any tenant, the cleanout, the estate sale and the repairs worth making, coordinated locally so out-of-state heirs do not have to fly in.
Market and sell
With full authority, heirs get a Notice of Proposed Action and the sale closes like a normal escrow. If the court has to confirm the sale, the hearing process goes in the listing so buyers know what to expect.
Close and walk the family through it
Title, escrow and the attorney stay coordinated through closing, and every heir gets walked through the closing statement, so nobody is surprised.
The team on every estate.
Probate attorney
A trusted probate attorney handles the court filings and the legal questions, which is where they belong. We are not attorneys.
Title and escrow
Title reviews the preliminary report before escrow opens, so old liens or name matches get cleared before listing. More in the Statement of Information.
Specialty lenders
When there is a mortgage on the inherited house, lenders who can help us understand what is owed and what the servicer can require.
Transaction coordinator
Keeps the paperwork, notices and deadlines on track from contract to closing.
What it looks like in practice.
A house unresolved for about 40 years
In January 2024, a son mentioned a property his family had never been able to resolve. The owner had died in 1985 without a will, and the house had sat in a decedent’s name for roughly 40 years. We started with the paper: the tax records, a preliminary title report, then a probate attorney we trust. In May 2025 the court appointed an administrator with full authority. The house listed in August 2026, drew six offers its first weekend and closed in September at $451,000, about five weeks after listing and with no court hearing.
$5,500 of paint, $19,000 over list
A 1955 Chula Vista home, 3 bedrooms and 2 baths, that came to the family through a living trust. The house was solid, but dated paint was holding it back. After about $5,500 of interior paint, it listed at $529,000 in November 2020 and closed in January 2021 at $548,000, $19,000 over list. By Ryan’s estimate, the paint added around $65,000 compared with selling it as it was.
What families say.
81 five-star reviews across Google, Zillow and Yelp.
“Very great home selling experience with Ryan. He was very knowledgeable and communicated very well. Made sure we knew everything involved and made the process very easy for us to sell. Would highly recommend to anyone selling their home.”
“I am so grateful for Ryans help to sell a property. He pulled out all of the stops he could to help us make it happen – he had the right contacts to get things fixed easily and cheaply, and he was willing to get stuck in to bring things to a close. He persisted with open houses and showings and when the right buyer found us, he was very supportive to negotiate and represented us well.”
“Very happy with Ryan and his marketing that took the sale of this house in a tough market and awkward time of the year during the holidays 40k over asking!! I am confident his communication skills with the other agent are what helped get this house under contract in under one week.”
“My husband and I were in the middle of a trip through Africa when we started the process of purchasing an investment property and we never even saw the home in person. Despite the distance and time zone challenges, Ryan made everything seamless from start to finish.”
“Ryan has been our go to realtor for over 6 years! He helped us buy our starter home in 2020, helped us sell it a few years later, and just recently got us into our (hopefully) forever home! He’s been absolutely fantastic to work with from start to finish. Could not recommend more.”
“Working with Ryan was truly an outstanding experience from beginning to end. Buying a home can be incredibly stressful (especially first time), but he made the entire process feel organized, manageable, and surprisingly smooth. … We never felt pressured or left in the dark.”

About Ryan Fisher.

I’m a San Diego Realtor and the founder of Lovery Real Estate, with $57M+ in career sales. I specialize in probate and trust sales, and I work with families across Chula Vista, Bonita, North Park, University Heights, Normal Heights and La Jolla, and throughout San Diego County.
I grew up around Fisher Bros. House Moving, the fifth-generation California house-moving business my family ran from the 1850s, and worked in it myself before real estate. That is why I can walk an older house with a family and tell them which repairs are worth making before a sale and which are not. More about how I work is in why hire Ryan Fisher as your San Diego Realtor.
Here are your options, here are the numbers, here is what I would do. No pressure. No sales pitch. Just results.

What does a probate real estate agent do?
A probate real estate agent sells a house that belonged to someone who has died, working for the executor, administrator or successor trustee and alongside the family attorney. That includes guidance before authority to sell, caring for and preparing the property, pricing, marketing and coordinating the sale through closing.
Is there a special license for probate real estate agents?
No. California does not issue a separate probate license. Any agent licensed by the California Department of Real Estate can list a probate or trust property, and private designations such as Certified Probate Real Estate Specialist are training courses, not state licenses. What matters is whether the agent understands the court process, works alongside a probate attorney and can care for the property while the estate waits for authority to sell.
When should I call a probate real estate agent?
Early. Before anyone has authority to sell, an agent can help the family understand the steps, check the title, estimate the value and start preparing the house, so it is ready to list the day authority is granted.
Can you list the house before the court gives authority to sell?
No. Nobody can sign a listing agreement or purchase contract for the estate until someone has authority. The family can use that time to clean out and prepare the house so it is ready to go.
Do I need a probate attorney if I have a probate real estate agent?
Yes. The attorney handles the court filings and the legal questions, such as which authority to seek and how the estate is distributed. The agent handles the house and the sale. Ryan works alongside a trusted probate attorney and is not an attorney himself.
Does the estate have to pay for repairs and preparation upfront?
Not with the Lovery Concierge Program. Ryan covers pre-listing work such as a design review, paint, flooring, light repairs, landscaping and trash cleanup upfront, and it is repaid through escrow when the home sells. Fees or interest may apply, and the terms are agreed in writing before any work begins.
Can I get a cash offer for an inherited house?
Yes. Ryan works with cash buyers and can bring the estate a cash offer to compare with listing on the open market, so the family can weigh speed against price with real numbers before deciding.
How do you price an inherited house?
Ryan prices it from recent comparable sales, both as is and prepared, so the family can see what preparation is worth before spending anything. In a California probate, a probate referee also appraises the property for the estate, and if the sale needs court confirmation, the price generally must be at least 90 percent of that appraised value.
Who takes care of a vacant inherited house?
Until the sale, the estate is responsible for the house. Ryan helps keep the utilities on, the insurance in place and the property checked, and coordinates the cleanout and any repairs. Tell the insurance company the house is vacant, because many standard policies limit coverage on vacant homes.
How much does a probate real estate agent cost, and can we cancel?
Commission is negotiable, set in writing in the listing agreement and paid from the sale at closing, and Lovery charges no admin or transaction coordinator fee. Every Lovery listing agreement says the seller may cancel at any time for any reason without penalty, prior to being under contract with a buyer.
Can I sell an inherited house from out of state?
Yes. The attorney referral, cleanout, vendors, photography, showings and closing are coordinated locally, and documents can be signed electronically from wherever the family lives.
Does a probate sale need court approval?
Not always. With full authority under the Independent Administration of Estates Act, heirs receive a Notice of Proposed Action and the sale can close like a normal escrow. With limited authority, or if an heir objects, the sale goes to a court confirmation hearing with possible overbids.
Do you also handle trust sales?
Yes. A house held in a living trust is sold by the successor trustee without a court case, but there are still notice requirements and title documents such as a certification of trust and an affidavit of death of trustee.
How often will the family hear from you?
Weekly updates to the family on every estate sale, and daily communication whenever the sale needs it.
What areas do you serve for probate sales?
Ryan works on probate and trust sales throughout San Diego County, with a focus on Chula Vista, Bonita, North Park, University Heights, Normal Heights and La Jolla.
